What can you do if an emergency room missed your diagnosis?

On Behalf of Weston Smith Law, PLLC | Aug 30, 2023 | Medical Malpractice

Emergencies are stressful, and you rely on emergency rooms to provide accurate and prompt care. But what if you discover that a Florida ER missed your diagnosis?

Such an oversight can be concerning, but by taking the right steps, you can safeguard your health and address the situation effectively.

Understand the issue

First, determine the impact of the missed diagnosis on your health. Not all misdiagnoses have immediate consequences, but you need to determine if the oversight has caused any harm or complications. If you feel worse or see new symptoms, seek medical attention promptly.

Get a second opinion

If you suspect that the ER missed something, it is a good idea to seek a second opinion. Schedule an appointment with a specialist or another medical professional to evaluate your condition. Explain your symptoms clearly and provide them with any tests or results from your ER visit. The law states that the ER must provide you with a copy of your records, and they have the right to charge you for that copy.

Document everything

Keep detailed records of your medical visits. Store any paperwork, test results and receipts in an organized manner. Make notes of the dates, times and names of medical professionals you spoke to. These records can be invaluable in understanding the sequence of events and in holding the ER accountable.

Communicate with the hospital

Approach the hospital administration and inform them about the missed diagnosis. They might want to review your case, which can lead to better training or protocols in the future. Hospitals often appreciate feedback as it can help improve patient care.

Stay proactive with your health

While addressing the oversight, do not neglect your health. Follow all medical advice, take prescribed medications and attend any recommended follow-up appointments.

Educate yourself

While doctors possess extensive training and experience, being an informed patient can help you ask the right questions and make better decisions about your care.

Discovering a missed diagnosis can be unsettling, but you have the power to address the situation. By taking these steps, you can navigate the complexities of the healthcare system with confidence.
